These Terms and Conditions (“Terms”) govern your use of the Sky Rail Golf website (store.skyrailgolf.com, hereafter “the Site”) and any purchase of products or services from the Site. By accessing the Site or placing an order, you agree to be bound by these Terms. These Terms are governed by the laws of Hong Kong SAR, and are intended to be compliant with Hong Kong law. If you do not agree to any of these Terms, please do not use our Site or services.
- Use of the Website
1.1 Eligibility: The Site and its services are intended for users who are of legal age in their jurisdiction. By using the Site, you represent that you are at least 18 years old (or the age of majority in your region) or have the consent of a parent or guardian. Use of the Site is void where prohibited by law.
1.2 Account Registration: To access certain features (such as purchasing products or memberships), you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account.

- Products, Orders and Payment
2.1 Product Information: We strive to display and describe our products (including physical goods, digital goods, and memberships) as accurately as possible. This includes providing information on product specifications, features, and pricing. However, we do not warrant that descriptions or other content are error-free, complete, or current. In particular, for physical products, please note that actual colors or designs may slightly vary from how they appear on your screen due to display differences.
2.2 Availability: All products and services are subject to availability. We reserve the right to limit the quantities of any products or services that we offer. We may, at our sole discretion, limit or cancel quantities per person or per order. In the event a product is out of stock or no longer available, we will attempt to remove it from the Site or indicate that it is unavailable. If you have already placed an order for an item that is out of stock, we will notify you as soon as possible and you will not be charged for unavailable items (or will receive a refund if payment was already processed).
2.3 Placing an Order: By placing an order on the Site, you are making an offer to purchase the selected product(s) or service(s) from us. After you submit an order, we will send you an order confirmation email acknowledging receipt of your order. This email is not an acceptance of your offer; it is simply a confirmation that we received your order. Our acceptance of your order and the formation of a binding contract between Asia Power International Limited (Sky Rail Golf) and you occurs when we dispatch the product(s) to you (or, for digital goods/memberships, when we make the digital product available to you or activate your membership). We reserve the right to refuse or cancel any order prior to acceptance, for example, if a product is mispriced, if we suspect fraud, or if we are unable to verify your payment or shipping information.
2.4 Pricing and Currency: Prices on the Site are listed in the currency stated (e.g., Hong Kong Dollars (HKD) by default, unless otherwise indicated). If you are purchasing from outside Hong Kong, currency conversion fees or credit card foreign transaction fees may apply (depending on your payment provider) and are your responsibility. All prices are subject to change without notice. In the event we discover a pricing error for an item you have ordered, we will contact you with the correct pricing and you may choose to proceed with or cancel the order. We are not obligated to provide a product to you at an incorrect (lower) price, even after we have sent an order confirmation, if the pricing error is obvious and could reasonably have been recognized by you as a mistake.
2.5 Taxes and Duties: Prices do not include any taxes, duties, or customs charges that may apply to your order. If any such charges apply, for example for international shipments, you are responsible for paying them as required by the governing authorities in your shipping destination. We will comply with Hong Kong SAR tax law requirements; for instance, sales within Hong Kong are not currently subject to sales tax (note: Hong Kong has no VAT/GST), but any applicable fees or duties for import into other countries are your responsibility.
2.6 Payment: We accept various payment methods as indicated at checkout (e.g., major credit cards, PayPal, etc.). By providing a payment method, you represent that you are authorized to use that method and that you authorize us (or our third-party payment processor) to charge your order total to that payment method. Payment processing is handled by third-party payment providers; we do not store your full credit card details on our own servers for security. If your payment is not received or is declined by the issuer, we reserve the right to cancel the order. All billing and registration information provided must be truthful and accurate. Providing any false or fraudulent information is a breach of these Terms and may result in cancellation of your order and potential legal action.
2.7 Digital Goods and Memberships – Delivery: If you purchase any digital goods (such as e-books, digital content, downloadables) or memberships from the Site, delivery is typically electronic. Upon successful payment, digital goods will be made available via download or account access, and membership benefits will be activated (e.g., access to members-only content or services). You understand that by purchasing digital goods or a membership, you gain immediate access to the content or service. For digital goods: By completing the purchase, you acknowledge that any statutory cancellation rights (such as cooling-off periods) may not apply once digital content has been delivered or accessed, to the extent permitted by law, since digital products are intangible and irreversible once delivered.
- Digital Goods and Memberships – Special Terms
3.1 License for Digital Content: When you purchase digital goods from Sky Rail Golf, you are granted a limited, non-transferable license to use the digital content for your personal, non-commercial use. All intellectual property rights in digital goods remain with us or the respective rights-holder; you do not own the content itself, and you may not distribute, duplicate, or resell it. Membership content (such as members-only videos, articles, or training materials) is also provided under a similar limited license for personal use during the active membership period.
3.2 Membership Subscriptions: If the Site offers membership programs or subscriptions (for example, a premium club membership or digital service subscription), additional terms may be presented at sign-up. Generally, memberships recur on the billing cycle disclosed (e.g. monthly or annually) and will automatically renew unless you cancel. You may cancel a membership subscription at any time via your account settings or by contacting us, effective from the next billing period. No pro-rated refunds will be provided for the remainder of a billing cycle if you cancel early, unless required by applicable law or explicitly stated otherwise in the specific membership terms.
3.3 Termination of Digital Services: We reserve the right to suspend or terminate your access to digital goods or memberships if we suspect any violation of these Terms (such as unauthorized sharing of content, or misuse of membership privileges). In such case, we may also terminate your account. If we terminate a membership through no fault of yours (for example, if we decide to discontinue a digital service entirely), we may provide a pro-rata refund for any prepaid period not fulfilled, or an alternative compensation as appropriate.
- Product Delivery (Physical Goods)
4.1 Shipping Regions: We offer worldwide shipping for our physical products, unless otherwise indicated for specific items. At checkout, you will be able to select from available shipping options for your destination country. If your location is not supported or if there are known restrictions (such as regulatory or logistical restrictions on certain goods), the Site may prevent you from completing an order to that address.
4.2 Shipping Times: Estimated shipping or delivery times will be provided when you place an order. These estimates are based on the shipping provider’s timelines. While we strive to meet these timelines, please note that actual delivery times can be affected by factors beyond our control (customs clearance, postal delays, international transit delays, etc.). We will not be liable for any delivery delays that are outside our reasonable control. However, if you have not received your package within a reasonable time after the estimated date, please contact us and we will assist in tracking or investigating the issue.
4.3 Title and Risk: Title to physical goods and the risk of loss or damage pass to you upon delivery of the product to the address specified in your order (or upon possession by you or your representative). It is your responsibility to ensure the accuracy of the delivery address and to promptly collect the package. If a package is returned to us due to an incorrect address or unclaimed at customs, we will contact you for further instructions; additional re-shipping charges may apply.
4.4 International Shipments: If you order from outside Hong Kong, your package may be subject to import taxes, customs duties, or fees levied by the destination country. These charges (if any) are not included in the product price or shipping cost at checkout. You (the buyer) are responsible for paying any such charges and complying with your country’s import regulations. We have no control over these charges and cannot predict their amount. Customs policies vary widely by country; you should contact your local customs office for further information. Additionally, international shipments may be opened and inspected by customs authorities.
- Returns, Exchanges, and Refunds

5.1 Return Window: If you are not satisfied with a physical product you purchased, you may request a return for a refund within 7 days of the date you received the product (based on the delivery confirmation date). Returns are subject to the product being in unused, original condition with all original packaging, tags, and accessories included. Some items may not be eligible for return (see Section 5.4).
5.2 Exchange Window: You may request an exchange (for a different size, color, or a different equivalent product) within 14 days of receiving a physical product. If more than 7 days have passed since delivery, we can only offer an exchange or store credit, not a refund. Exchanges are also subject to the product being in resalable condition (unused and with original packaging).
5.3 Return/Exchange Procedure: To initiate a return or exchange, you must contact us (via the contact email provided) within the above timeframes and provide your order number, the item(s) you wish to return/exchange, and the reason. We will respond with instructions, including the return shipping address and any return merchandise authorization (RMA) number if applicable. You must send the item back to us within a specified time (typically a further 7 days after we approve the return) to remain eligible. It is recommended to use a trackable shipping service for returns, and you must bear the return shipping costs for returns and exchanges. We do not provide return shipping labels; the customer is responsible for paying and arranging the return shipment. We also do not refund any original shipping fees paid on the order (those are non-refundable).
5.4 Non-Returnable Items: Certain products cannot be returned or exchanged unless they arrive damaged or defective. These may include:
• Digital goods or downloadable products (once delivered or accessed, these are not returnable due to their nature).
• Gift cards or vouchers.
• Any item marked “Final Sale” or “Non-Returnable” on the product page.
• Items that have been used, worn, or not in their original condition.
• Any request made outside the permitted return/exchange window.
5.5 Condition of Returns: All returned items must be in original, unused condition. This means the product should be unworn/unused, with no signs of wear or damage, and returned in the original packaging (boxes, plastic wrap, inserts, tags, etc., as applicable). We reserve the right to inspect returned items and decline returns or exchanges if the items are not in acceptable condition. If a return is declined (for example, if a returned item is found to be used or damaged by the customer), we may send it back to you at your expense or dispose of it, at our discretion.
5.6 Refund Process: If your return is approved, we will process your refund within a reasonable timeframe. Refunds will be issued to the original payment method. Please note that it may take additional time for your bank or credit card company to post the refund to your account (often 5–10 business days). If the original payment method is unavailable (e.g., an account is closed), we will work with you to determine an alternative method. The refund will cover the purchase price of the returned item(s) minus any original shipping charges, which are non-refundable. If you received any promotional or free items (e.g., buy-one-get-one or gifts) and do not return them, their retail value may be deducted from the refund if applicable.
5.7 Exchange Process: If you requested an exchange, once we receive the original item and verify its condition, we will ship the replacement item to you. The cost of shipping the replacement item to you must be covered by you (we will provide an invoice for the new shipping charge, or deduct it from any balance or ask you to pay it before shipment). If the item you want in exchange is of a different price, we will communicate any difference: for a higher-priced item, you will need to pay the difference before we ship; for a lower-priced item, we can refund the difference or issue store credit. Each original purchase is eligible for one exchange transaction; exchanged items cannot be returned or exchanged further, except at our discretion or if the exchanged item arrived damaged/defective.
5.8 Defective or Incorrect Products: If the product you received is defective, damaged, or not what you ordered (e.g. wrong item or size), please contact us immediately (within 7 days of receipt) with details and photos if possible. In such cases, upon verification, we will arrange either a replacement or a refund at our cost. For defective/incorrect items, we will cover the return shipping cost or provide a return shipping label, and you will not be charged additional shipping for the replacement item. Please do not dispose of or repair a defective item without our approval, as that may void your ability to return it.
5.9 Digital Goods and Memberships – Refunds: Digital products (such as e-books, digital downloads, or codes) are generally non-refundable once purchased and delivered, due to the immediate access nature of the product (we cannot “undo” a digital delivery). By completing a purchase for a digital good, you acknowledge that you waive any right to cancel or obtain a refund, except where required by law. Membership fees are also typically non-refundable after the membership has started, especially if any member content has been accessed, except at our discretion or if required by law. If you believe there is an exceptional circumstance (for example, you accidentally purchased the same digital item twice, or you were unable to access the digital content due to technical issues on our side), please contact us and we will review your case.
5.10 International Returns: If you are returning a product from outside Hong Kong, clearly mark the parcel as “Returned Goods” to avoid customs charges. We are not responsible for any customs fees or duties that may be incurred on returns; any such charges will be deducted from your refund if imposed. Additionally, ensure you comply with the return timeframe (based on delivery date to you) as international transit time for the return will count toward the window. We recommend using a courier service with tracking for international returns.
5.11 Legal Right of Cancellation (if applicable): These return rights are provided in addition to any statutory rights you may have under consumer protection laws. For example, if you are a consumer in the United Kingdom or European Union, you may have a legal right to cancel an order for physical goods within 14 days of receipt for any reason (cooling-off period) and receive a refund. However, if you exercise such rights, you will generally still be responsible for return shipping costs. If such laws apply to your purchase and are more favorable than our policy, we will honor your rights under the applicable law. (Note: Digital goods are usually exempt from EU/UK cancellation rights once download/access has begun, as acknowledged above.)
- Limitation of Liability
6.1 Use of Site & Products: Asia Power International Limited (Sky Rail Golf) provides the Site and all products and services on an “as is” and “as available” basis. While we endeavor to maintain a safe, secure, and functioning service, we do not guarantee that the Site will be uninterrupted or error-free, or that any defects will be corrected immediately. To the fullest extent permitted by law, we make no warranties (express or implied) regarding the Site or the products sold, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. Any reliance on the material on this Site is at your own risk.
6.2 Indirect Damages: To the extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages of any kind, or any loss of profits or revenues, loss of data, or loss of business or goodwill, arising out of or in connection with your use of the Site or purchase/use of any products or services, whether in contract, tort (including negligence), strict liability or otherwise, even if we have been advised of the possibility of such damages. In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability will be limited to the maximum extent permitted by law.
6.3 Cap on Liability: To the extent permitted by law, our total liability to you for any claims arising from or related to the use of the Site or purchase of products (whether in contract, tort, or any other form of liability) is limited to the amount you paid us for the product or service in question. For example, if your claim arises from a product you bought from us, our maximum liability is the price you paid for that product.
6.4 No Limitation for Certain Rights: Nothing in these Terms shall exclude or limit our liability for: (a) death or personal injury caused by our negligence or willful misconduct; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable law (for example, under Hong Kong’s Control of Exemption Clauses Ordinance, liability for personal injury or death resulting from negligence cannot be excluded). If you are a consumer, your statutory rights are not affected by this clause.
6.5 Indemnity: You agree to indemnify and hold harmless Asia Power International Limited (Sky Rail Golf) and its directors, officers, employees, and agents, from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your breach of these Terms, your use of the Site, or your violation of any law or the rights of a third party.
- Governing Law and Dispute Resolution
7.1 Governing Law: These Terms and any separate agreements whereby we provide you products or services shall be governed by and construed in accordance with the laws of Hong Kong SAR. This choice of law is selected on the basis that our company is registered and operating in Hong Kong. If you are accessing the Site from outside Hong Kong, you do so on your own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
7.2 Jurisdiction: You agree that the courts of Hong Kong SAR shall have jurisdiction to adjudicate any dispute arising out of or relating to these Terms or your use of the Site or purchase of products. However, we reserve the right to seek injunctive or equitable relief in any jurisdiction if necessary to protect our interests or enforce our rights. If you are a consumer based outside Hong Kong, you may also have rights to bring an action in your country of residence under applicable consumer protection laws. Nothing in this clause limits any consumer rights for dispute resolution that you may be entitled to under mandatory law.
7.3 Good Faith Resolution: Before resorting to formal legal proceedings, we encourage you to contact us to resolve any issue amicably. We will consider reasonable requests to resolve the dispute through alternative dispute resolution mechanisms, such as mediation or arbitration, as an alternative to litigation, especially if both parties agree.
7.4 Time Limit on Claims: To the extent permitted by law, any claim or cause of action you have arising out of or related to use of the Site or these Terms must be filed within one (1) year after such claim or cause of action arose, or it will be permanently barred. (This does not apply to consumers in jurisdictions that prohibit such time limits.)
- Miscellaneous
8.1 Changes to Terms: We may update or modify these Terms from time to time. If we make material changes, we will post the revised Terms on this page with an updated “Last Updated” date. It is your responsibility to review these Terms periodically for any changes. Your continued use of the Site following the posting of changes constitutes acceptance of those changes.
8.2 Entire Agreement: These Terms (along with the Shipping & Refund Policy and Privacy Policy referenced herein) constitute the entire agreement between you and Asia Power International Limited (Sky Rail Golf) regarding the subject matter hereof, and supersede any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including any prior versions of the Terms).
8.3 Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permissible and the remaining provisions of the Terms will remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
8.4 Assignment: You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations to a third party (for example, in the event of a merger, acquisition, or sale of assets, or by operation of law) without your consent. These Terms will inure to the benefit of and be binding upon each party’s successors and permitted assigns.
8.5 Third-Party Rights: A person who is not a party to these Terms has no right to enforce any term of these Terms under the Contracts (Rights of Third Parties) Ordinance (Cap. 623 of Hong Kong) or otherwise, except where stated otherwise.
8.6 Language: These Terms are written in English. If they are translated into another language (for example, for informational purposes), the English version shall prevail in case of any discrepancy or conflict.
